Acceptable Use Policy

1. Scope

This Acceptable Use Policy (“AUP”) applies to the use of the hosting, cloud, and platform services provided by gh0stservice GmbH, in particular the product “gh0stcloud”.

This policy applies to all customers, users, end users, contractual partners, and any third parties who access our services through a customer or otherwise use our infrastructure indirectly.

2. Description of Services

gh0stservice GmbH provides digital cloud, hosting, and platform services. Through gh0stcloud, customers may use technical resources such as compute capacity, storage, networking, platform services, and hosting infrastructure.

Billing may be usage-based. In such cases, the resources used by a customer are measured proportionally and invoiced accordingly.

3. Permitted Use

Our services may only be used for lawful purposes and within the scope of the agreed services.

Permitted use includes, in particular:

  • operating legitimate websites, applications, APIs, and digital services
  • hosting proprietary or commissioned software solutions
  • storing and processing lawful data
  • developing, testing, and operating technical applications
  • business or private cloud and hosting use, provided such use does not violate this policy or applicable law

4. Prohibited Use

The use of our services is prohibited where such use is unlawful, abusive, harmful, or high-risk.

In particular, the following activities are prohibited:

  • sending spam, unsolicited bulk emails, or abusive messages
  • phishing, identity theft, social engineering, or fraudulent activities
  • distributing, operating, or supporting malware, viruses, botnets, ransomware, spyware, or similar harmful software
  • attacking systems, networks, or services, including DDoS attacks, port scans, brute-force attacks, or unauthorized penetration testing
  • hosting or distributing illegal content
  • infringing copyrights, trademarks, data protection rights, or other third-party rights
  • operating services primarily intended to circumvent laws, sanctions, access restrictions, blocking measures, or security controls
  • using the services for fraudulent, misleading, or deceptive business models
  • unauthorized collection, processing, or publication of personal data
  • activities that endanger the stability, security, or integrity of our platform, our infrastructure, or the services of other users
  • use for illegal financial activities, money laundering, terrorist financing, or sanctions-related violations
  • hosting content or services that promote violence, exploitation, abuse, or other serious unlawful acts

5. Compliance with Laws and Regulations

Customers are required to comply with all applicable laws, regulations, official requirements, and third-party rights.

This includes, in particular, laws and regulations relating to data protection, IT security, copyright, telecommunications, export control, sanctions, consumer protection, fraud prevention, and other relevant legal areas.

Our services may not be used by persons, organizations, or in countries where such use would violate applicable sanctions, embargoes, or export control regulations.

6. Customer Responsibility

The customer is responsible for all content, data, applications, user accounts, activities, and transactions carried out through their access, instances, projects, or allocated resources.

This also applies to actions by employees, contractors, end customers, sub-users, or other third parties to whom the customer grants access to our services.

The customer is required to keep access credentials secure, implement appropriate security measures, and prevent misuse of their resources.

7. Abuse, Fraud, and Harmful Content

Customers may not use our services to host, distribute, or make available abusive, fraudulent, harmful, or unlawful content.

We reserve the right to review reports of abuse and take appropriate action if there is a violation of this policy, applicable law, or third-party rights.

8. Monitoring and Enforcement

We are not obligated to continuously and actively monitor customer content or activities. However, we reserve the right to take technical and organizational measures to ensure security, stability, abuse prevention, and compliance with this policy.

In the event of actual or suspected violations of this AUP, we may, in particular:

  • request a statement or remedial action from the customer
  • temporarily restrict individual content, services, instances, or access
  • suspend or disable affected resources
  • partially or fully suspend use of the platform
  • terminate contracts for cause
  • remove unlawful content or disable access to it
  • notify authorities, payment service providers, or affected third parties where legally required or necessary to protect legitimate interests

In cases of serious, urgent, or security-relevant violations, measures may be taken without prior notice.

9. Changes to this Policy

We reserve the right to amend this Acceptable Use Policy where necessary, in particular due to changes to our services, legal requirements, security requirements, or requirements imposed by payment service providers or infrastructure partners.
